These Terms of Service ("Terms") govern the use of services provided by South Sea Marine Co., LTD. ("Company", "we", "us") and the use of our website at southseamarine.com. By engaging our services or using this website, you agree to these Terms.

2. Services
South Sea Marine provides yacht refit, renovation, repair, maintenance and management services. We operate from multiple marina locations across Phuket, including Royal Phuket Marina, Yacht Haven Marina, Ao Po Grand Marina and Boat Lagoon.
The specific scope, timeline and cost of each project are defined in individual written quotations and service agreements. These Terms apply in addition to any project-specific agreement.
3. Estimates and Quotations
- Initial estimates provided through our website or consultation are non-binding and indicative only
- Formal quotations are valid for 30 days from the date of issue unless stated otherwise
- Additional work discovered during a project (hidden damage, osmosis, structural issues) will be communicated to the client with a revised quotation before proceeding
- Prices are quoted in Thai Baht (THB) unless otherwise agreed. Foreign currency payments are subject to exchange rate at the time of payment
4. Payment Terms
- A deposit of 40-50% is required before project commencement
- Progress payments are invoiced at agreed milestones
- Final balance is due upon project completion and before vessel launch or handover
- Accepted payment methods: bank transfer, credit card (Visa, Mastercard). Bank transfer charges are borne by the sender
- Late payments may incur interest at 1.5% per month on the outstanding balance
5. Project Timeline
Estimated project durations are provided in good faith based on the known scope of work. Timelines may be affected by:
- Discovery of additional work during the project
- Parts and materials supply delays
- Adverse weather conditions (typhoon season, heavy rain during outdoor work)
- Client-requested changes to the scope of work
- Marina scheduling (haul-out, launch availability)
We will communicate any material delays promptly. Delays caused by factors outside our reasonable control do not constitute a breach of contract.
6. Warranty
- Workmanship warranty: 12 months from project completion on all labour and craftsmanship
- Paint and coatings: covered under manufacturer warranty terms (Awlgrip, Jotun, International). We assist with warranty claims where applicable
- Mechanical and engineering: parts carry manufacturer warranty; our labour is warranted for 6 months
- Teak decking: 24 months warranty on installation workmanship, subject to proper maintenance
Warranty does not cover damage resulting from improper use, lack of maintenance, modifications by third parties, normal wear and tear, or exposure to conditions beyond the design specification.
7. Liability
Our total liability for any claim arising from a project shall not exceed the total contract value of that specific project. We are not liable for:
- Loss of use, revenue or profit during the refit period
- Consequential or indirect damages
- Pre-existing defects not identified in the initial survey
- Damage caused by third parties, weather events or acts of nature while the vessel is in our care (we recommend clients maintain comprehensive marine insurance at all times)
8. Client Responsibilities
- Provide accurate information about the vessel, its history and known defects
- Maintain valid marine insurance throughout the project period
- Respond to approval requests and change orders within a reasonable timeframe
- Remove personal valuables from the vessel before project commencement
- Arrange necessary Thai customs and immigration documentation for foreign-flagged vessels
9. Cancellation
- Cancellation before project start: deposit is refundable minus 15% administration fee and any costs already committed (materials ordered, subcontractors booked)
- Cancellation during project: client is liable for all work completed, materials purchased and committed subcontractor costs
- We reserve the right to pause or terminate a project in case of non-payment
10. Intellectual Property
All design drawings, technical specifications and project documentation created by South Sea Marine remain our intellectual property. Photographs of completed projects may be used in our portfolio and marketing materials unless the client requests otherwise in writing before project commencement.
11. Website Use
The content on southseamarine.com is provided for general information purposes. While we strive for accuracy, we do not guarantee that all information is complete, current or error-free. Service descriptions, pricing examples and timelines on the website are indicative and subject to the terms of individual project agreements.
12. Governing Law
These Terms are governed by the laws of the Kingdom of Thailand. Any dispute arising from these Terms or our services shall be resolved through the courts of Phuket Province, Thailand, unless an alternative dispute resolution method is agreed in writing.
13. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of our services after changes constitutes acceptance of the revised Terms.
